The TSE halts campaign events and public funds for Deltan Dallagnol

Brazil’s Superior Electoral Court suspended Deltan Dallagnol’s campaign events, Senate candidate for Paraná for the Novo party, and also blocked the transfer of resources from the Electoral and Party funds for his candidacy.
According to G1 Globo, the precautionary decision was signed by Justice Floriano de Azevedo Marques, who also asked the TSE presidency to bring the case to a vote in the virtual or in-person full bench in the coming days.
The ruling responded to a request from the Paraná Para Todos coalition and the Brasil da Esperança Federation, which appealed the decision of the Regional Electoral Court of Paraná that had authorized Dallagnol to run.
According to G1 Globo, the request included the suspension of public resources for the campaign and the ban on airing free electoral advertising on radio and television, as well as other campaign acts, including participation in debates.
In his decision, Marques said that the TSE had already unanimously held, in another 2022 case, that Dallagnol’s resignation from his post as prosecutor of the Republic was a fraud on the law, since it sought to prevent 15 administrative proceedings pending before the National Council of the Public Prosecutor’s Office from becoming administrative disciplinary proceedings.
Still according to the ruling cited by G1 Globo, the subsequent filing of those cases at the CNMP occurred because Dallagnol stopped being part of the Public Prosecutor’s Office and not because of an acquittal. The justice also stated that, at the time of the resignation, there were no elements indicating a favorable decision for the candidate and that, on the contrary, the possible application of sanctions such as dismissal or compulsory retirement was expected, a situation that, according to that criterion, would have left him ineligible to run.
Now, the case must be analyzed by the seven justices who make up the TSE.
