Paraguay’s Chamber of Deputies sends Memby Law reform to the Senate

The Chamber of Deputies approved, article by article, the bill known as Ley Memby and sent it to the Senate for consideration, according to ABC Color.
The proposal amends and expands Article 189 of Law No. 1680/01, the Child and Adolescent Code. According to ABC Color, the initiative was promoted by lawmaker Federico “Fredy” Franco, of the PLRA.
The bill seeks to clarify the mechanisms for automatic deductions of child support payments. It also proposes setting a unified amount and establishing its automatic update in line with changes in the minimum wage, with the aim of avoiding the need to request a new court ruling each year solely to adjust that amount.
Another point noted by ABC Color is that, in the event of noncompliance with the support obligation, the court would be empowered to order enforcement measures without the need to open a new judgment enforcement proceeding.
Among those measures are the immediate withholding of up to 50% of the support payer’s regular income, including salaries, pensions, retirement benefits, bank accounts and other variable sources, in addition to the automatic deduction of the support payment and direct registration in the Registry of Delinquent Child Support Debtors (Redam).
