Cristina Kirchner requested a new calculation of her pension and payment of retroactive amounts
The former president asked the social security court to order ANSES to recalculate the reinstated benefit and lift a 20% deduction. She also requested that amounts dating back to April be paid.
Cristina Kirchner filed a claim before the social security court for ANSES to recalculate the pension that was reinstated to her and pay retroactive amounts. She also challenged the resolution under which a 20% deduction was applied to the benefit to recover sums the agency considered to have been received improperly.
According to Radio Mitre, ANSES carried out the payment of the allowance for a gross amount of $16,090,877.01 to comply with an injunction issued in February by Chamber 3 of the Federal Social Security Court, with the votes of Juan Fantini and Sebastián Russo.
The legal filing argues that, when the benefit was reinstated, not only the pension corresponding to August should have been paid, but also the amounts for the previous months since April 24, the date on which the injunction became final after an extraordinary appeal against that ruling was rejected.
It was also requested that the calculation be made in accordance with Supreme Court of Justice Agreement No. 20. Radio Mitre noted that the claim also seeks to avoid withholdings linked to income tax and to challenge the deduction applied by ANSES.
Crónica added that the filing was made by an attorney while the former president is under house arrest.
